It is now 3mo after settlement and I have lodged a formal complaint via Office of the Legal Services Commissioner against Tony who is now completely unresponsive to all forms of communication. 1. Tony informed us that the property we purchased was a Torrens Title property. In fact it was Old System Limited Title property. How did you get this wrong? If the bank did not grant approval at the 11th hour we would have lost our 205,000 deposit. 2. We have no consolidated financial breakdown after selling and buying property through Tony. Over 3m worth of property was involved an no usable report. We still cannot run the numbers on our transaction 3mo later. Most ad hoc photocopies Tony supplied were illegible due to poor resolution. 3. On the day of settlement Tony advised an unexpected shortfall of 85,985.14 at 1.42pm. We visited banks to expedite the moving of funds between accounts and made the full amount available at 3.30pm. By this time the bank's treasury had closed and we could not settle, being charged 2,236.39 in penalties. Lawyers from the bank state the shortfall amount was made available to Tony the day before yet I was not informed until the afternoon of the day of settlement. How about checking at 9am in the morning if 3m is exchanging so we have reasonable time to act and would not have suffered any penalties? As stated, Tony is completely unresponsive and I have lodged a formal complaint via Office of the Legal Services Commissioner to recover all legal fees paid to Tony and penalties I was charged.
Tony has acted as my conveyancer now for over 10 years, and over this time he has helped me buy and sell four properties.
